Trial Team Leader Elinor Leary and Attorney Clifton Smoot filed a lawsuit against Farmington Fresh Sales, LLC, for negligence and negligent hiring, supervision, and training. The lawsuit was filed on behalf of Ronny Reynoso, who was severely injured on Farmington Fresh’s property after two forklifts collided resulting in steel materials hitting Reynoso in the head.
Reynoso, a truck driver for Guntert Sales Div., Inc., was delivering steel materials to Farmington Fresh Sales’ job site. Farmington Fresh Sales employees carelessly loaded the large, heavy steel beams onto a forklift. Moments later, another Farmington Fresh forklift driver collided with the loaded forklift, which caused the steel materials to hit Reynoso in the head and seriously injure him.
“Farmington Fresh had a duty to exercise reasonable care while loading and operating their forklifts. They were aware that forklift traffic is potentially hazardous to delivery truck drivers, and Ronny has suffered due to Farmington Fresh’s carelessness,” said Leary.
