State of California on behalf of a correctional officer who was injured on his way to work. The trial court had initially granted summary judgment, but the case was revived on appeal in a published decision that clarifies prior uncertainty in the area of workers’ compensation exclusivity for workers who lease property from their employers.

Winnett obtained a $2.92 million settlement on behalf of the family of Carlos Amezcua, a career tree trimmer who died when he fell out of the bucket of an aerial lift while trimming trees. Mr. Amezcua was performing his work duties when the leveling chain within the boom broke, causing the bucket to tip and Mr. Amezcua to fall to his death.

On Wednesday, October 4, Governor Jerry Brown signed landmark legislation Senate Bill 33, introduced by Senator Bill Dodd (D-Napa) and co-sponsored by the Consumer Attorneys of California (CAOC). The bill will go into effect Jan. 1, 2018 and will prevent another Wells Fargo-sized scandal by allowing consumers to fight financial institutions in court instead of through secretive arbitration in cases involving bank fraud.

Trial Team Leader Craig Peters and Attorney David L. Winnett’s case Doe vs. Mazda was featured in San Francisco Chronicle’s Northern California Verdicts section. The case involved a high-speed traffic collision where a truck ran into Doe’s stopped Mazda Protege, causing the Mazda’s car seatback to collapse and fold in half on impact. This seatback failure caused serious and life-altering injuries to the plaintiff, and the jury returned a verdict in her favor on April 1, 2016 for $14.9 million.

Elinor Leary and Clifton Smoot filed a lawsuit on behalf of Carlos Perezdeleon against Rush Truck Leasing and Maxon Lift Corporation for negligence, product liability and loss of consortium. The lawsuit alleges that Maxon Lift Corporation designed and manufactured a defective liftgate that was hazardous, and that Rush Truck Leasing failed to maintain the liftgate in a reasonably safe condition and failed to warn the plaintiff that the liftgate was not functioning. The liftgate fell on Carlos’ foot, crushing it.

Trial Team Leader Elinor Leary and Attorney Alexandra Hamilton filed a lawsuit on behalf of Viktor Fedchuk for negligence against PSP Property Maintenance, whose employee allegedly threw a 20-pound industrial fan/motor from the rooftop, striking Viktor in the head and causing severe injuries. The lawsuit states that during the repair of a rooftop air conditioner, a PSP Property Maintenance employee recklessly threw the industrial fan/motor from the rooftop instead of safely lowering it to the ground. The industrial fan/motor landed on Viktor’s head 25 feet below and resulted in serious head and neck injuries, which could have been prevented had the facility simply taken the proper steps to safely dispose of the air conditioning unit.
