Breaking News: Mercedes Benz Must Face Class Action for Sprinter Vans with Leaking AC Units

On April 7, 2015, U.S. District Judge Thelton E. Henderson allowed a class action lawsuit to proceed against Mercedes Benz for selling Sprinter vans with air conditioners that leak water inside of the vehicle. As reported in Law360, the court denied defendant’s motion to dismiss the product liability and consumer protection claims. (The court dismissed the fraud claim with leave to amend.) Plaintiff Digby Adler Group, a company that rents customized Sprinter vans to musicians, alleges that most of its 98 Mercedes Benz Sprinter vans leak water from the roof-mounted AC unit. The complaint states that the Sprinter air conditioner leaked water right from the start, which damaged the interior and the musicians’ expensive equipment. Mercedes Benz allegedly told the company that it was working on repairing the Sprinter AC water leak, but the problems continued. Plaintiffs are represented by Anthony Label and Steven Kronenberg of the Veen Firm and by Jonathan Gertler, Daniel Gildor, and Samuel Cheadle of Chavez & Gertler, LLP.
